Terms & Conditions

Effective Date: August 5, 2026

1. Scope of Services

MUSÉE Creative is a creative studio offering:

  • Real Estate Photography
  • Commercial & Business Photography
  • Brand & Portrait Photography
  • Website Design & Development
  • Branding & Visual Identity
  • Creative Consulting

The specific deliverables, pricing, and timeline for each engagement are defined in the signed proposal, booking confirmation, or service agreement between MUSÉE Creative and the client.

2. Client Responsibilities

To keep every project on schedule, the client agrees to:

  • Provide complete and timely content, including text, images, logos, and brand assets
  • Respond to requests, feedback, and approvals within the agreed timeframe
  • Ensure all provided materials do not infringe on third-party rights
  • Provide necessary access to hosting accounts, domains, and third-party platforms when required

Delays caused by missed deadlines or incomplete materials may result in revised timelines and additional fees.

3. Photography Services

The following applies to all photography engagements:

  • Clients are responsible for ensuring the property or location is photo-ready before the scheduled session.
  • MUSÉE Creative is not responsible for cleaning, staging, decluttering, landscaping, or moving heavy furniture.
  • Delays caused by unprepared properties may reduce shooting time or incur additional fees.
  • Weather-dependent sessions may be rescheduled when necessary.
  • Additional editing requests beyond the included package may incur additional charges.
  • Standard delivery timelines are provided at booking and begin after the session, not at booking.
  • Delivered photography is licensed for the client's marketing and promotional use as outlined in the service agreement.

4. Website Design Services

The following applies to all website design and development projects:

  • Clients must provide all required content by the deadlines outlined at kickoff.
  • Each project includes a defined number of revision rounds; additional revisions may be billed at our standard hourly rate.
  • Written approval is required at each project milestone.
  • Unless otherwise agreed, hosting, domain registration, SSL, and third-party subscriptions are the responsibility of the client.
  • The client owns and controls their domain unless a formal transfer is arranged in writing.
  • Third-party plugins, fonts, and stock assets remain licensed by their respective providers.
  • Launch occurs after final approvals and full payment are received.
  • MUSÉE Creative applies current SEO best practices, but no specific rankings or search engine placement are guaranteed.

5. Project Timelines

Project timelines are estimates based on the agreed scope. Timelines begin once the signed agreement and initial retainer are received. MUSÉE Creative is not responsible for delays caused by factors outside of our control, including client delays, third-party service outages, or force majeure events.

6. Payment Requirements

A booking retainer or deposit reserves project dates and begins work. Unless otherwise agreed:

  • The remaining balance is due before final delivery of edited images, website files, or other deliverables.
  • Late payments may delay delivery or launch.
  • Additional work outside the original scope requires written approval and may be billed separately.
  • All fees are non-refundable except as stated in our Refund Policy.

7. Cancellations & Rescheduling

  • Photography reschedules: Complimentary with at least 24 hours' notice; inside 24 hours a new retainer may be required.
  • Weather delays: Weather-related reschedules initiated by MUSÉE Creative are always complimentary.
  • Client cancellations: Retainers and deposits are non-refundable.
  • No-shows: Failure to appear for a scheduled session without notice forfeits the retainer.
  • Website postponements: Projects paused by the client for more than 30 days without communication may be closed and payments retained.
  • Missed meetings: May be rescheduled once at no cost; repeated missed meetings may extend the project timeline.
  • Client delays: Timelines may shift when content, feedback, or approvals are delayed.

8. Ownership & Intellectual Property

Website Projects

Upon full payment, the client owns the final custom website deliverables created specifically for their project. MUSÉE Creative retains ownership of proprietary processes, reusable components, templates, and internal systems unless otherwise agreed in writing.

Photography

Clients receive a commercial usage license for approved business and marketing purposes. MUSÉE Creative retains copyright to all photographs. Images may not be sold, transferred, relicensed, or redistributed to third parties without written permission.

Stock assets, licensed fonts, and third-party plugins remain governed by their original licenses. The client is responsible for maintaining any required licenses for such materials.

9. Portfolio Rights

Unless otherwise agreed in writing, MUSÉE Creative reserves the right to display completed work across:

  • Portfolio
  • Website
  • Social media
  • Marketing materials
  • Case studies
  • Promotional materials

10. Travel & Service Area

MUSÉE Creative serves clients throughout its standard service area. Projects outside of this area may incur travel fees, which will always be disclosed and agreed upon before booking is confirmed.

11. Confidentiality

Any client information, login credentials, business information, and project materials shared during an engagement are treated confidentially and used only for the completion of the requested services.

12. Limitation of Liability

MUSÉE Creative's liability is limited to the total amount paid for the specific project or service giving rise to the claim. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption.

13. Governing Law

These Terms & Conditions are governed by the laws of the State of South Carolina. Any disputes arising from these terms will be resolved through good-faith negotiation or in the appropriate jurisdiction within South Carolina.

14. Changes to These Terms

MUSÉE Creative may update these Terms & Conditions at any time. The most current version will always be available on this page. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
